Childminders Without Domestic Premises

A guide to the 2025/2026 legislation allowing childminders to operate entirely from non-domestic settings.

What has changed?

The Department for Education has introduced sweeping flexibilities for childminders operating on non-domestic premises.

Historically, a "childminder" was legally defined as someone who provided childcare in a domestic premises (a home). If you wanted to work from a village hall, you had to register as "Childcare on Non-Domestic Premises," which carried significantly more regulatory weight and higher fees.

Under the current framework, childminders have two clear pathways to operate in non-domestic settings:

"Childminders without domestic premises": A dedicated registration category for professionals operating 100% of the time from a non-domestic setting (e.g. church halls, community hubs). Under this category, you are strictly prohibited from providing care in any home environment at any time.
Adding non-domestic premises to a standard registration: The old rule requiring childminders to spend at least 50% of care time at home has been abolished. You can now flexibly split your time between home and a hall (hourly, daily, or weekly) by submitting an EYA form to add the premises to your standard registration.

2026 Update: Your setting will be evaluated via the new Ofsted Report Card, receiving grades on a 5-point scale (Exceptional to Urgent Improvement) across 6 core areas, with Safeguarding as a standalone "Met/Not Met" judgement.

Location Flexibility

Operate 100% of the time from community halls, village centres, or commercial units.

Flexible Split

The old 50% home-based rule is gone. Split time flexibly between home and a hall via an EYA form.

Simplified DBS

DBS checks are for 'Childcare Workforce' only; household members do not require checks.

Staffing & Daycare Limit

Work with up to 3 assistants (4 people total). 5+ assistants triggers full nursery/daycare registration.

Suitability & Vetting

Ofsted will inspect your chosen venue to ensure it meets EYFS safety and learning standards.

The Suitability Criteria

01.Vetting & Timing: Ofsted conducts suitability visits within a target timeline of 9 weeks from application. You must declare if you have sole use or a shared facility.
02.DBS Vetting: You and assistants need an Enhanced DBS check with barred lists. Because it's not a home, apply for a "Childcare Workforce" position (no home-based check required).
03.Health & Good Conduct: Must provide a GP-completed health declaration and, if you lived abroad in the past 5 years, a certificate of good conduct.

Planning Permissions

Although existing halls may have commercial usage, local authorities often require explicit planning permission if childminder numbers exceed six children or if assistants are employed.

Note: Structural modifications (e.g. outdoor shelters, free-flow gates) must account for the costs and timelines of local planning approval.

Assistant-to-Child Ratio Rules

Ratios are identical to home-based care. Safeguarding and First Aid are mandatory.

Statutory EYFS Ratios

Each adult can care for a maximum of 6 children under 8 years old.
Of those 6, a maximum of 3 can be under 5, and typically only 1 can be under 1.
For 2-year-olds, the statutory minimum staff-to-child ratio is 1:5.
Assistants must hold valid Paediatric First Aid (PFA) and safeguarding training to be left unsupervised or counted in ratios.

Nursery Registration Threshold

A single childminder registration allows you to work with up to 3 assistants (4 people total).

⚠️ Nursery Trigger: If you work with 5 or more other people (making a team of 6+ adults), you can no longer operate as a childminder. You must register as "Childcare on Non-Domestic Premises" (nursery/daycare rules and inspections apply).
