As a solo childminder, your legal limit is 1 childminder to 3 children under 5, with no more than 1 of those children under 1 year old. Exceeding these ratios risks your Ofsted registration.

The Early Years Foundation Stage (EYFS) Statutory Framework sets strict age-bracket limits. Getting them right protects your registration and maximises your setting's income.

The Standard Staff:Child Ratios

As a solo childminder in the UK, care for a maximum of six children at any one time, provided they are under the age of eight. Within that group, two sub-limits apply:

• Children under 5 years: Maximum three children in this age group.
• Babies under 1 year: Maximum one baby at any one time.

A compliant setting might include one baby (under 1), two toddlers (aged 1–4), and three school-aged children (aged 5–7) — six children total. Your own children count towards these ratios if they are under eight and present while you are childminding.

The 'Rising Fives' Rule: Unlocking Capacity

The "Rising Fives" rule increases your earning potential during school hours. A child who has reached their fourth birthday counts as being in the 'five-and-over' age group if they attend a school reception class full-time.

This frees up one of your three "under 5" slots during the school day. Take on a new toddler or baby during those hours, effectively increasing your capacity for younger, full-time children while the older child is at school.

Indoor Floor Space Requirements

Verify your space before accepting any child. Ofsted inspectors measure rooms and check you can supervise all children from a single position.

EYFS space requirements are measured in square metres of clear floor space per child:

• Under 2 years: 3.5 m² per child
• Two-year-olds: 2.5 m² per child
• Three to five-year-olds: 2.3 m² per child

Count only rooms regularly used for children's play and learning — your living room, dining room, or a dedicated playroom. Exclude hallways, bathrooms, and small kitchens. A 15 m² living room gives you physical capacity for four toddlers (4 × 2.5 m² = 10 m²), but your ratio cap still limits you to three.

Navigating Exceptions

Ofsted recognises specific circumstances where you exceed your usual ratios. These "Exceptions" are typically granted for keeping siblings together or maintaining continuity of care when a child's family circumstances change.

Demonstrate that you meet the individual needs of all children in your care. Exceptions are never permitted to cover a new business enquiry or to cover for a friend — they must serve the best interests of children already in your setting.
